What does 49 CFR 107.807 (Approval of non-domestic chemical analyses and tests) require?
Generated guidance. Confirm the source and its applicability before you act. How we check sources.
Based on 49 CFR 107.807, if you want to manufacture DOT specification or special permit cylinders outside the United States, you must get an approval from the Associate Administrator to perform the required chemical analyses and tests outside the U.S.
To apply for this approval, you must submit an application that includes the following:
* The information required in § 107.705(a).
* The name, address, and a description of each facility where the cylinders will be manufactured and where the tests and analyses will be performed.
* Complete physical details and drawings of each cylinder type (such as dimensions, construction materials, wall thickness, water capacity, shape, joints, and openings), including calculations for wall stress and thickness.
* The name of the independent inspection agency that will certify the tests and analyses, along with a statement from that agency confirming it is independent and not owned by a cylinder manufacturer, owner, or distributor.
* The signature of the person making the certification and the date signed.
Additionally, under 49 CFR 107.807, you must allow the Associate Administrator (or their designee) to inspect your manufacturing and testing facilities and records upon request, and you must provide any requested materials and cylinders for testing. You are also responsible for paying the costs for these initial and subsequent inspections, analyses, and tests.
