As a motor-carrier owner, when you file a registration, report, application for an approval, or a renewal or modification of an approval under 49 CFR 107.705, you must meet the following requirements:
1. Where and How to File: Send your document and any supporting attachments to the Associate Administrator for Hazardous Materials Safety (Attention: Approvals, PHH-32), Pipeline and Hazardous Materials Safety Administration, U.S. Department of Transportation, East Building, 1200 New Jersey Avenue, SE., Washington, DC 20590-0001. Alternatively, you can file by fax (at 202-366-3753 or 202-366-3308) or by email ([email protected]).
2. Identify the Chapter Section: State the specific section of the chapter under which your filing is made.
3. Reference Numbers: If the report is required by an approval, registration, or special permit, include that specific number.
4. Contact and Company Information: Provide the name, street and mailing addresses, optional email address, and telephone number for both the person making the filing and the person on whose behalf it is being made (if they are different).
5. Non-Residents: If the person on whose behalf you are filing does not reside in the U.S., you must designate a service agent in accordance with § 105.40.
6. Description of Activity: Provide a description of the activity that requires the registration or report.
7. Additional Information: Provide any extra information requested by the Associate Administrator if they determine your filing lacks pertinent details or is non-compliant.
Additional Requirements for Approval Proposals:
If you are applying for an approval (or a modification or renewal), you must also include:
* A description of the activity requiring the approval.
* The proposed duration of the approval.
* The affected transport mode(s).
* Any additional information specified in the section containing the approval.
* If the approval provides exceptions from regulations: identify any increased risks to safety or property, specify measures to address those risks, and provide analyses/evaluations demonstrating your activity will achieve a level of safety at least equal to the required regulation.
* For medical device lithium cells and batteries transported under § 173.185(g), provide details on whether the destination(s) receive daily cargo aircraft service.
Renewals and Modifications:
File renewals or modifications in the same manner as an original application. If you want to prevent your existing approval from expiring while awaiting a final administrative decision, you must submit a complete renewal application that meets these requirements at least 60 days before your current approval expires. (Operating under an expired approval not filed within 60 days of the expiration date is prohibited).
Confidentiality:
If you want to request confidential treatment for information in your application, you must comply with § 105.30(a).
