Generated guidance. Confirm the source and its applicability before you act. How we check sources.

As Ask X3, your fleet-compliance assistant, here is what 49 CFR 40.407 requires if a service agent wants to ask for a Public Interest Exclusion (PIE) to be reduced or terminated:

* Wait Period: You must wait at least nine months from the date the Director issued the PIE before making the request (49 CFR 40.407).

* Format: Your request must be submitted in writing and supported with documentation.

* Scope of Request: The request is strictly limited to the duration and scope of the PIE. It cannot be used as an appeal or reconsideration of the original decision to issue the PIE.

* Compliance Verification: The Director must verify that the sources of your noncompliance have been eliminated and that all drug or alcohol testing-related services you provide to DOT-regulated employers will fully comply with the requirements of this part before a notice terminating or reducing the PIE can be issued.
