What does 49 CFR 173.476 (Approval of special form Class 7 (radioactive) materials) require?
Generated guidance. Confirm the source and its applicability before you act. How we check sources.
Based on 49 CFR 173.476, the requirements for special form Class 7 (radioactive) materials are as follows:
* Recordkeeping and Safety Analysis: You must keep a complete safety analysis on file for at least two years after your latest shipment, and provide it to the Associate Administrator upon request. This analysis must include test documentation proving the material meets § 173.469 requirements. (Alternatively, an IAEA Certificate of Competent Authority satisfies this requirement.)
* Export Shipments: Before your first export shipment of a special form Class 7 material from the U.S., you must obtain a U.S. Competent Authority Certificate for that specific material. For materials manufactured outside the U.S., an IAEA Certificate of Competent Authority from the country of origin can be used instead.
* Certificate Requests: If you request a U.S. Competent Authority Certificate, you must submit it in writing (in triplicate) by mail or delivery service, or via fax to (202) 366-3753 or (202) 366-3650, or by email to [email protected]. Requests must be received at least 90 days before the requested effective date and must include:
1. A detailed description of the material or capsule contents (including physical and chemical states).
2. A detailed statement of the capsule design and dimensions, including complete engineering drawings (8 1/2" x 11"), material schedules, and construction methods.
3. A statement of tests and results, calculative evidence, or other proof that the material complies with § 173.469.
4. Evidence of a quality assurance program (based on international, national, or other standards) covering design, manufacture, testing, documentation, use, maintenance, and inspection for original requests.
5. A description of proposed pre-shipment actions (like leak testing).
*Note: These requirements do not apply if $A_1$ equals $A_2$ and the material does not need to be described on shipping papers as “Radioactive Material, Type A Package, Special Form” or “Radioactive Material, Type A Package, Special Form, Fissile.”*
