What does 49 CFR 40.48 (What steps must operators of collection sites and collectors take to protect the security and integrity of oral fluid collections?) require?

Based on 49 CFR 40.48, operators of collection sites and collectors must take specific steps to protect the security and integrity of oral fluid collections and prevent unauthorized access or tampering:

For Collectors:

* Before each collection, you must restrict access to collection materials and specimens, ensure no undetected access (such as through an unmonitored door) is possible, and secure the facility to maintain the employee's privacy and prevent distractions by posting limited-access signs.

* To avoid distractions, conduct a collection for only one employee at a time. The only exception is if one employee is in a "dry mouth" fluid-drinking period (under § 40.72(b)(1)), during which you may handle another collection as long as the dry-mouth employee remains supervised.

* Keep the employee's collection container within the view of both you and the employee, to the greatest extent practicable, from the time the specimen is provided until it is sealed.

* Ensure that you are the only person, other than the employee, who handles the specimen before it is sealed with tamper-evident seals.

* Remain within the collection site between the time the employee gives you the specimen and when you seal it.

* Maintain personal control over each specimen and the Custody and Control Form (CCF) throughout the entire collection process.

For Collection Site Operators:

* Implement policies and procedures to prevent unauthorized personnel from entering any area where oral fluid specimens are collected or stored.

* Allow only authorized persons into the site—specifically: employees being tested, collectors and collection site workers, DERs, employer/employee representatives authorized by employer policy or collective bargaining agreements, and DOT agency representatives.

* Ensure all authorized persons are supervised by a collector at all times while in the site.

* Remove any person who obstructs, interferes with, or delays the collection process.

* Minimize the number of people handling the specimens.
