What does 49 CFR 40.111 (When and how must a laboratory disclose statistical summaries and other information it maintains?) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

Based on 49 CFR 40.111, the laboratory must follow these requirements for disclosing statistical summaries and information:

* Semi-Annual Summaries to Employers: The laboratory must send an aggregate statistical summary (by employer and specimen type, as listed in appendix D) to you on a semi-annual basis.

* The summary for the period of July 1 through December 31 of the prior year must be sent by January 20.

* The summary for the period of January 1 through June 30 of the current year must be sent by July 20.

* *Protections:* The summary must never reveal an employee's identity. Additionally, the laboratory will not send you a summary if you have fewer than five aggregate test results, to prevent anyone from inferring an individual's test result.

* Summaries for DOT Audits: If you request a summary in response to a DOT agency inspection, audit, or review, the laboratory must provide it (unless you had fewer than five aggregate test results, in which case they will send a report stating there was not enough testing to warrant a summary). This can be transmitted by hard copy, fax, or electronic means.

* Other Releases: The laboratory must also release information to appropriate parties as outlined in §§ 40.329 and 40.331.

* Summaries to the DOT: The laboratory must send an aggregate statistical summary (listed in appendix E) to the DOT semi-annually by January 31 (for July 1–December 31 of the prior year) and by July 31 (for January 1–June 30 of the current year). If the laboratory's certification is withdrawn or removed, they must provide this summary to DOT-regulated employers and ODAPC for their final reporting period.
