What does 49 CFR 40.109 (What documentation must the laboratory keep, and for how long?) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

As a motor-carrier owner, according to 49 CFR 40.109, the testing laboratory must keep the following documentation for a minimum of two years:

* All records related to each employee urine specimen.

* Employer-specific data required in § 40.111.

Additionally, if the Medical Review Officer (MRO), the employee, your company (the employer), or a DOT agency sends a written request within that two-year period asking to keep the records longer (such as for litigation or a safety investigation), the laboratory must comply with that request. If no such request is made, the laboratory may discard the records after two years.
