Railroad-crossing stops under 49 CFR 392.10
Editorial correction · sources checked 2026-10-02
Short answer
The mandatory stop under 49 CFR 392.10 applies to the vehicle classes specified in that section, subject to its exceptions. It is not a blanket stop requirement for every commercial motor vehicle.
In plain English
Covered vehicles include buses transporting passengers, specified hazardous-material vehicles, and specified cargo tank vehicles. For a covered crossing, stop 15 to 50 feet from the tracks, look and listen, and cross only when safe without shifting gears on the tracks. Read paragraphs (a)(1)–(6) for the precise vehicle and load categories and paragraph (b) for crossing exceptions.
Drivers of other commercial motor vehicles have separate precautions under 49 CFR 392.11, including slowing enough to determine that the course is clear. State law and posted traffic controls can add requirements.
What to do
• Identify the vehicle, load, placards, and crossing controls.
• Apply the specific category and exceptions in the current rule.
• Never enter a crossing unless there is room to clear it.
