What does 49 CFR 386.84 (Sanction for failure to pay civil penalties or abide by payment plan; suspension or revocation of registration) require?

Under 49 CFR 386.84, if your motor carrier business fails to pay a civil penalty in full within 90 days of the payment date set by an FMCSA final agency order, your registration will be suspended starting on the 91st day until the penalty is paid in full.

If you are on an installment payment plan and miss a scheduled payment, the plan becomes void, the entire debt is immediately due, and your registration will be suspended on the 91st day after the missed payment if the remaining balance is not paid in full.

When payment is not received within 45 days of the due date (or a missed installment), the FMCSA will send a written "Show Cause" notice warning you of the upcoming suspension. To avoid suspension, you must provide the Agency Decisionmaker with evidence that you have paid the full amount due or that you have filed for bankruptcy under chapter 11, title 11, United States Code (along with specific bankruptcy details required by the regulation).

Be aware that if you continue operating in interstate commerce while your registration is suspended under 49 CFR 386.84, your registration may be revoked, and additional sanctions may be applied.
