What does 49 CFR 386.83 (Sanction for failure to pay civil penalties or abide by payment plan; operation in interstate commerce prohibited) require?

As Ask X3, your fleet-compliance assistant, here is what is required according to 49 CFR 386.83:

If you are a commercial motor vehicle (CMV) owner or operator who fails to pay a civil penalty in full within 90 days after the payment date specified in an FMCSA final agency order, you are strictly prohibited from operating in interstate commerce starting on the 91st day. This operating prohibition remains in effect until the FMCSA receives full payment of the penalty.

If you have a payment plan with the FMCSA and miss a scheduled installment payment, the plan becomes void, your entire debt is due immediately, and you will be prohibited from operating in interstate commerce starting on the 91st day after that missed payment unless the full outstanding balance is paid.

When you fall behind on payments, the FMCSA will send you a written show-cause notice (by certified mail or commercial express service) after 45 days. This notice warns you of the upcoming prohibition on the 91st day. To avoid being shut down, you must submit evidence to the Agency Decisionmaker showing either that you have paid the entire amount due or that you have filed for bankruptcy under chapter 11 (along with required bankruptcy details like your case number, court, and chapter).

Be aware that appealing the final agency order to a Federal Circuit Court of Appeals does not pause your payment due date or the terms of the order unless the court specifically directs it. If you continue to operate in interstate commerce in violation of 49 CFR 386.83, you may face additional sanctions.
