What does 49 CFR 385.705 (Expedited action) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

As a motor-carrier owner, under 49 CFR 385.705, if your non-North America-domiciled motor carrier commits certain violations (such as using drivers with invalid CDLs, operating out-of-service vehicles, having specific hazardous materials incidents, using drivers who test positive for drugs/alcohol, lacking required financial responsibility, or hitting a driver/vehicle out-of-service rate of 50% or more), you may be subjected to an expedited compliance review or be required to submit a written response demonstrating corrective action.

If the Agency demands a written response showing corrective action, you must respond within 30 days. Failure to respond within 30 days will result in the suspension of your new entrant registration until you submit the required showing to the FMCSA. Additionally, providing a satisfactory response does not excuse you from still having to undergo a compliance review during your new entrant registration period.
