What does 49 CFR 385.607T (FMCSA action on the application) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

Based on 49 CFR 385.607T, FMCSA takes the following actions and imposes the following requirements regarding your application:

* Application Review and Validation: FMCSA reviews and acts on your application, and checks available government databases in your home country and the United States to validate the accuracy of your information and certifications.

* Pre-Authorization Safety Audit: If you are a non-North America-domiciled motor carrier, you must satisfactorily complete an FMCSA-administered safety audit before you can get new entrant registration. This audit reviews your written procedures and records to check your application information and verify that you have basic safety management controls in place.

* Handling of Protests (For-Hire Authority): If you request for-hire operating authority and your application is protested, new entrant registration will only be granted if FMCSA denies or rejects the protest. If there is no protest, you will receive registration after successfully completing the pre-authorization safety audit and waiting for the protest period to expire.

* Requirements to Start Operations: If FMCSA grants your new entrant registration, you will be assigned a distinctive USDOT Number. Before you can start operating in the U.S., you must:

* Have your insurance or surety provider file proof of financial responsibility.

* File a hard copy of Form BOC-3 (Designation of Agents) or have your process agent(s) submit it electronically.

* Safety Monitoring System: You must comply with all safety monitoring system provisions, which include passing North American Standard commercial motor vehicle inspections at least every 90 days and having required safety decals on each commercial motor vehicle you operate in the United States.

* Transition to Permanent Registration: FMCSA will not change your registration status from "new entrant" to "permanent" until at least 18 months after your USDOT Number is issued, provided you successfully complete the safety monitoring system (including earning a Satisfactory safety rating from a compliance review).
