What does 49 CFR 380.725 (Documentation and record retention) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

Based on 49 CFR 380.725, training providers eligible for listing on the Training Provider Registry (TPR) must keep specific records for a minimum of three years from the date each record is generated or received (unless a local, State, or Federal requirement mandates a longer retention period).

Specifically, you must retain the following documents:

1. Self-certifications from accepted behind-the-wheel (BTW) training applicants. These must state that the applicant will comply with U.S. DOT regulations (parts 40, 382, 383, and 391) and State/local laws regarding alcohol and controlled substances testing, age, medical certification, licensing, and driver records.

2. Copies of driver-trainees' commercial learner's permits (CLPs) or commercial driver's licenses (CDLs), as applicable.

3. Instructor qualification documentation, which includes their driving and/or training experience, along with copies of their CDLs and applicable endorsements.

4. Lesson plans for both theory and BTW (range and public road) training curricula.

5. Records of individual entry-level driver training assessments (as described in § 380.715).

*Note:* If an instructor's CDL expires or is canceled, you must retain their most recent, valid CDL.
