As Ask X3, your fleet-compliance assistant, here are the requirements under 49 CFR 173.471 for offering a Type B(U), Type B(M), or fissile material package approved by the U.S. Nuclear Regulatory Commission (USNRC) under 10 CFR part 71:

* USNRC Registration and Compliance: You must be registered with the USNRC as a party to the packaging approval and make the shipment in compliance with the terms of that approval.

* Package Marking: The outside of each package must be durably and legibly marked with the package identification marking shown in the USNRC packaging approval.

* Shipping Papers: Each shipping paper related to the shipment must also bear the package identification marking indicated in the USNRC packaging approval.

* Export Shipments: Before exporting the package, you must obtain a U.S. Competent Authority Certificate for the package design, or register in writing as a user of an already issued certificate (including a description of your 10 CFR part 71 quality assurance program). Submit your registration to the Associate Administrator for Hazardous Materials Safety via mail, fax, or email (`[email protected]`). Once you receive the certificate, you must submit a copy of it to the national competent authority of each country you will transport into or through, unless you have proof they already have it.

* Competent Authority Certificate Requests: If you are requesting a U.S. Competent Authority Certificate per IAEA regulations, you must submit the request in writing in triplicate to the Associate Administrator at least 90 days before the requested effective date. The request must include copies of the USNRC packaging approval, your USNRC Quality Assurance Program approval number, and a reproducible 22 cm × 30 cm (8.5″ × 11″) drawing of the package make-up.
