According to 49 CFR 173.23, the regulations govern the continued use of previously authorized packagings as follows:

* "ICC" Marked Packagings: You may use a packaging marked prior to January 1, 1970, with the prefix "ICC" in place of a "DOT" specification packaging, provided the packaging otherwise conforms to applicable specification requirements.

* Seamless Aluminum Cylinders (SP/Exemption 6498, 7042, 8107, 8364, or 8422): Manufactured in conformance with and for use under these specific DOT special permits or exemptions, these may continue to be used if they were marked before or at the time of their next retest with either the specification identification "3AL" right above the special permit/exemption number, or the DOT mark (e.g., DOT 3AL 1800) close to the special permit/exemption marking.

* Cylinders/Spheres (SP/Exemption 6616): Manufactured and marked prior to January 1, 1983, these may continue in use if marked before or at the time of the next retest with the specification identification "4BA" near the special permit or exemption marking.

* Cylinders (SP/Exemption 6668 or 8404): Manufactured for use under these specific special permits or exemptions, these may continue in use but must have been marked "DOT-4LXXXYY" (with XXX as the service pressure, and YY as "AL" if applicable) on or before January 1, 1986. This marking must be placed close to the other required special permit or exemption markings.

* MC 331 Cargo Tank Motor Vehicles: These must conform to the structural integrity requirements found in § 178.337-3 or to the corresponding requirements that were in effect when they were manufactured.

* Non-Bulk Packagings: A non-bulk packaging manufactured, tested, marked, and certified on or before September 30, 1996, in accordance with the rules in effect on September 30, 1995, may be used as authorized if it conforms to all requirements that applied at the time of manufacture. Additionally, it may be reused under § 173.28 without a nominal thickness marking as long as it meets the minimum thickness criteria in § 173.28(b)(4).

* Packagings with Incorporated Special Permits: A packaging permanently marked with a special permit number ("DOT-SP" or "DOT-E") whose provisions have since been incorporated into the subchapter may continue to be used for the rest of its operational life without needing to remove or obliterate the special permit number.

* Exemption Packagings or Shipping Papers Marked "DOT-E": Any exemption packaging or shipping paper permanently marked "DOT-E" before October 1, 2007, may continue to be used as long as the exemption or special permit remains valid, unless the specific exemption or exemption terms state otherwise.
