What does 49 CFR 40.177 (What does the second laboratory do with the split specimen when it is tested to reconfirm the presence of a drug or drug metabolite?) require?

Based on 49 CFR 40.177, when the second laboratory tests a split specimen to reconfirm the presence of a drug or drug metabolite, it must:

* Test the split specimen specifically for the drugs or drug metabolites that were confirmed in the primary specimen.

* Conduct this testing without regard to the cutoff concentrations listed in § 40.85 or § 40.91.

* Conduct validity tests to determine why it could not reconfirm the drug or metabolite, using the same validity tests applied to a primary specimen under § 40.87 or § 40.93, if the test fails to reconfirm the presence of the original drug(s) or metabolite(s).

* Send the specimen (or an aliquot of it) to another HHS-certified laboratory capable of conducting another reconfirmation test, if the test fails to reconfirm the presence of the drug or metabolite reported in the primary specimen.
