According to 49 CFR 40.163, the Medical Review Officer (MRO) is responsible for reporting all drug test results to the employer.
The MRO may report these results using the following methods:
* Copy 2 of the CCF: Using a signed or stamped and dated legible photocopy of Copy 2 of the CCF (note that Copy 1 of the CCF must never be used to report results).
* Written Report: Providing a written report (such as a letter) for each test result if Copy 2 is not used.
* Electronic Data File: As an exception, negative results may be reported using an electronic data file.
Required Information:
If the MRO uses a written report or an electronic data file, it must include specific minimum details such as the employee's full name, specimen ID and SSN/employee ID, reason for the test, collection date, date the MRO received Copy 2 of the CCF, test result and verification date, and specific additional details depending on whether the test was positive, cancelled, or a refusal. Electronic reports must also include the MRO's contact information, the reporter's name, and the release date.
Important Restrictions & Recordkeeping:
* The MRO must not provide quantitative values for drug or validity test results to the DER or C/TPA.
* Completed copies of Copy 2 of the CCF (signed and dated by the MRO for all results, or stamped and dated by MRO staff for negatives only), along with copies of written reports or retrievable electronic reports, must be retained.
* Reports and records for negatives and cancelled results must be kept for one year, while records for positives and refusals must be kept for five years (unless otherwise specified by DOT regulations).
