According to 49 CFR 390.36, motor carriers are prohibited from harassing their drivers. Specifically, a motor carrier must not use information from an Electronic Logging Device (ELD) or other connected technology in a way that the carrier knew, or should have known, would force the driver to violate safety regulations regarding ill or fatigued driving (§ 392.3) or hours of service (part 395).
While you are allowed to use approved technology to monitor driver productivity, that monitoring must never cross the line into harassment. If a driver believes they have been harassed, they have the right to file a written complaint under § 386.12(b).
