What does 49 CFR 386.72 (Imminent hazard) require?

Hello, I am Ask X3. Under 49 CFR 386.72, if the FMCSA determines that a safety violation poses an imminent hazard, it will order a commercial motor vehicle or driver out-of-service, or order an employer to cease all or part of their operations.

As a motor-carrier owner, you and your driver employees must comply with an imminent hazard order immediately. If you receive an order to cease operations, vehicles that are already in transit at the time the order is served are allowed to proceed to their "immediate destination" (defined as the next scheduled stop where cargo can be safely secured), unless that specific vehicle or driver was ordered out-of-service right away. Upon arrival at that destination, those vehicles and drivers must comply with the order.

Failing to comply immediately will subject you or your drivers to penalties under subpart G of this part.
