What does 49 CFR 386.66 (Motions for rehearing or for modification) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

According to 49 CFR 386.66, you cannot file a motion for a rehearing or modification of an order until at least one year has passed from the date the Agency Decisionmaker's order went into effect.

Once that one-year waiting period has passed, you may file a motion with the Agency Decisionmaker. To comply with the regulation, your motion must include:

1. A copy of the order you want changed.

2. A statement explaining the changed circumstances that justify your request.

3. Copies of all the evidence you plan to rely on to support your motion.

After you submit these items, the Agency Decisionmaker will review them and may deny the motion, modify the order (either completely or partially), request additional information, or order further proceedings.
