As Ask X3, your fleet-compliance assistant, here is what is required under 49 CFR 385.415 for transporting hazardous materials that require a safety permit:

1. Documents to Carry in the Vehicle

During transport, you must keep the following items in each commercial motor vehicle and make them available to authorized federal, state, or local government officials upon request:

* A copy of your safety permit, or another document that clearly shows your FMCSA Safety Permit number.

* A written route plan meeting the specific requirements of § 397.101 (for highway route-controlled Class 7 radioactive materials) or § 397.67 (for Division 1.1, 1.2, and 1.3 explosives).

* The direct phone number (including area code or country code) of a carrier employee or representative who knows the shipment's route and can verify it is in the correct general area. This phone must be answered directly by a person at all times while the material is in transport or in storage incidental to transport—answering machines are not allowed.

2. Pre-Trip Inspections for Class 7 (Radioactive) Materials

Before transporting a highway route-controlled quantity of Class 7 radioactive material, you must have a pre-trip inspection performed on the vehicle in accordance with the “North American Standard Out-of-Service Criteria and Level VI Inspection Procedures.”

3. Communications Plan and Records

* Your drivers must follow the required communications plan by contacting your company at the beginning and end of each duty tour, as well as at the pickup and delivery of each permitted load (contact can be made via telephone, radio, or electronic tracking/monitoring).

* You or your driver must keep a record of these communications for 6 months after the shipment is initially accepted. The record must include the driver's name, vehicle identification, the permitted materials being transported, and the date, location, and time of each required contact.

4. Lost or Stolen Shipments

* If you suspect that a shipment of a hazardous material requiring a permit is lost, stolen, or otherwise unaccounted for, you must contact the Transportation Security Administration's Transportation Security Coordination Center immediately at 703-563-3236 or 703-563-3237.
