What does 49 CFR 383.141 (General) require?

Based on 49 CFR 383.141, the requirements are as follows:

* For State Agencies: A State cannot issue, renew, upgrade, or transfer a hazardous materials endorsement (HME) for a Commercial Driver's License (CDL) unless the Transportation Security Administration (TSA) has determined the individual does not pose a security risk, or the individual holds a valid Transportation Worker Identification Credential (TWIC). Additionally, States must require HMEs to be renewed every 5 years or less so drivers undergo TSA security screening at least every 5 years.

* State Notification to Drivers: At least 60 days before a CDL or HME expires, the State must notify the holder that they must pass the TSA security threat assessment process to renew the endorsement. The notice must advise the driver to file their renewal application as soon as possible—and no later than 30 days before the expiration date—to expedite the screening.

* For Drivers/Applicants: To receive or renew an HME, an individual must successfully complete the TSA security threat assessment process (or hold a valid TWIC). Anyone who does not successfully complete this security assessment cannot be issued the endorsement.
