According to 49 CFR 382.719, drug and alcohol violation information for a driver will remain available to employers conducting a Clearinghouse query until all of the following conditions are met:
1. The Substance Abuse Professional (SAP) reports the required information to the Clearinghouse.
2. The employer reports that the driver's return-to-duty test results are negative.
3. The driver's current employer reports that the driver has successfully completed all follow-up tests prescribed in the SAP report.
4. Five years have passed since the date of the violation determination.
Once every single one of these four conditions is satisfied, the violation information will no longer be available to employers querying the Clearinghouse.
