Based on 49 CFR 382.411, as a motor-carrier owner, you are required to do the following:
1. Pre-employment drug tests: You must notify a driver of their pre-employment controlled substances test results if the driver requests them within 60 calendar days of being notified about the disposition of their employment application.
2. Random, reasonable suspicion, and post-accident drug tests: You must notify a driver if these test results are verified as positive, and you must inform them which specific controlled substance(s) were verified positive.
3. Unreachable drivers: Your designated employer representative must make reasonable efforts to contact and request every driver who submitted a specimen (regardless of whether they are still employed) to contact and discuss their test results with the medical review officer (MRO) if the MRO has been unable to reach them.
4. MRO notification: Your designated employer representative must immediately notify the MRO that the driver has been instructed to contact the MRO within 72 hours.
