As a motor-carrier owner, here is what 49 CFR 178.801 requires regarding Intermediate Bulk Containers (IBCs):
* General Standards: IBCs containing hazardous materials must be able to withstand normal transportation conditions and meet minimum safety requirements. They must be manufactured and assembled so they can successfully pass prescribed tests and comply with § 173.24 at all times in transportation.
* Manufacturer Responsibilities: The IBC manufacturer must ensure each IBC can pass the required tests and achieve successful design qualification testing at the start of production.
* Your Responsibilities (As the Offeror): To the extent that you perform any IBC assembly functions (including final closures) when offering hazardous materials for transportation, you are responsible for carrying out those functions according to §§ 173.22 and 178.2.
* Testing Requirements: Manufacturers must conduct design qualification testing, periodic design requalification testing (at least once every 12 months to maintain production authorization), production testing (leakproofness tests on IBCs intended for liquids or solids discharged by pressure), and initial production inspections.
* Proof of Compliance: The Associate Administrator (or a designated representative) can require a manufacturer at any time to demonstrate compliance through performance testing or by providing a sample IBC.
* Record Retention: Test reports must be prepared following design qualification tests and periodic retests, and they must be maintained and made available to users or Department representatives according to specific timeframes outlined in the regulation.
