What does 49 CFR 173.461 (Demonstration of compliance with tests) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

Based on 49 CFR 173.461, compliance with the design requirements in § 173.412 and the test requirements in §§ 173.465 through 173.469 must be shown by using any of the following methods, or an appropriate combination of them:

1. Physical Testing: Test prototypes or samples of LSA-III, special form Class 7 radioactive material, or packaging. The contents inside the packaging during the test must closely simulate the expected physical properties of the actual radioactive contents and be prepared as they normally would be for transport. Using non-radioactive substitute contents is encouraged, as long as the test results account for the radioactive characteristics of the actual contents.

2. Reference to Past Demonstrations: Refer to a previous, satisfactory demonstration of compliance that is of a sufficiently similar nature.

3. Scale Models: Test appropriate scale models that include features significant to the item being investigated, provided engineering experience shows this method is suitable for design purposes. If you use a scale model, you must adjust certain test parameters (such as penetrator diameter or compressive load) as needed.

4. Calculations or Reasoned Evaluation: Use reliable and conservative procedures and parameters to calculate or reasonably evaluate compliance.

Additionally, for the initial conditions of the tests under §§ 173.465 through 173.469 (except for water immersion tests), you must base your compliance on the assumption that the package is in equilibrium at an ambient temperature of 38 °C (100 °F).
