What does 49 CFR 173.232 (Articles containing hazardous materials, n.o.s) require?
Generated guidance. Confirm the source and its applicability before you act. How we check sources.
According to 49 CFR 173.232, articles containing hazardous materials (defined as machinery, apparatus, or other devices containing one or more integral hazardous materials that cannot be removed for transport) must meet the following requirements:
* Classification & Naming: If the article does not have an existing specific proper shipping name in the § 172.101 Table, it must be classified under this section based on the hazards present. (Articles with existing specific proper shipping names, or those containing Class 1, Division 6.2, Class 7, or radioactive materials, are excluded). If the article contains Class 9 materials alongside other hazardous materials, all other materials are considered a higher hazard.
* Batteries: Any integral lithium batteries must be of a type proven to meet the UN Manual of Tests and Criteria, Part III, subsection 38.3 testing requirements.
* Subsidiary Hazards & Reactions: Subsidiary hazards must represent the primary hazard of the contained materials. If an article contains multiple hazardous materials that could react dangerously with one another during transport, you must enclose each of them separately.
* Packaging Standards:
* Standard packagings must conform to the Packing Group II performance level using authorized drums (1A2, 1B2, 1N2, 1H2, 1D, 1G), boxes (4A, 4B, 4N, 4C1, 4C2, 4D, 4F, 4G, 4H1, 4H2), or jerricans (3A2, 3B2, 3H2).
* Robust articles may use non-specification strong outer packagings of adequate strength and design, or be transported unpackaged/on pallets if the article affords equivalent protection.
* Containment & Cushioning:
* The containment must ensure no leakage of hazardous materials can occur if the internal receptacles are damaged (a leakproof liner may be used).
* Receptacles holding hazardous materials must be securely cushioned and fixed to prevent breakage, leakage, and movement during normal transport. Cushioning materials must not dangerously react with the contents or have their protective properties substantially impaired by any leakage.
* Gas receptacles and filling densities must meet applicable subchapter requirements unless otherwise approved.
