Based on 49 CFR 173.184, the regulation requires the following for highway or rail fusees:
* Composition and Performance: Fusees must be designed to burn at a controlled rate for signaling. Their composition must prevent spontaneous ignition or marked decomposition when exposed to 75 °C (167 °F) for 48 consecutive hours.
* Packaging Requirements: Fusees must be packed in approved metal drums (steel, aluminum, or other metal), metal jerricans (steel or aluminum), metal boxes (steel, aluminum, or other metal), wooden boxes (regular, plywood, or reconstituted wood), fiberboard boxes, plywood drums, or fiber drums.
* Spiked Fusees: If fusees have spikes, the outer packaging must feature reinforced ends to stop spikes from poking through. The packaging must also pass Packing Group II drop tests (under 49 CFR part 178), including at least one drop with a spike pointing downward.
* Highway Transportation & Flagging Kits: For highway transport, railroad flagging kits are exempt from other subchapter requirements only if they strictly meet the following conditions:
* Allowed Contents: Kits may only contain specific rail/highway fusees (NA1325, Div 4.1, PG II) and specified pyrotechnic/signal devices (UN0431, UN0373, UN0191, UN0193).
* Container Standards: Fusees and torpedoes must be carried in compartmented metal containers where each compartment has a latching cover. Torpedo compartments must have a spring-loaded positive locking device, and each compartment can hold only one type of device.
* Quantity Limits: Each kit can hold a maximum of 36 fusees and 36 railroad torpedoes. A motor vehicle may transport no more than six (6) flagging kits at one time.
* Vehicle Restrictions: Flagging kits may only be transported on railroad motor vehicles, which includes privately owned motor vehicles directly controlled by on-duty railroad employees.
* Storage Rules: Fusees and torpedoes must remain inside closed flagging kits whenever they are not in use on the railroad right-of-way, while the vehicle is being driven, or when the vehicle is on non-railroad property.
* Unattended Vehicles: If left in an unattended motor vehicle on non-railroad property, the flagging kit must be locked inside the vehicle or kept in a locked compartment on the vehicle.
