What does 49 CFR 173.165 (Polyester resin kits) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

According to 49 CFR 173.165, polyester resin kits consist of a base material component (Class 3 or Division 4.1, Packing Group II or III) and an activator component (Type D, E, or F organic peroxide that does not require temperature control).

To comply with the regulations, you must follow these practical requirements:

* Organic Peroxide Inner Packagings: The organic peroxide component must be packed in inner packagings with a net capacity of not more than 125 mL (4.22 fluid ounces) each for liquids, or 500 g (17.64 ounces) each for solids. *(Note: Different limits apply for aircraft transport).*

* Flammable Liquid/Solid Component: Except for aircraft transport, suitable inner packagings must be used for the flammable liquid component.

* Same Outer Packaging: The flammable liquid or solid component and the organic peroxide component may be packed in the same outer packaging *only if* they will not interact dangerously if a leak occurs.

* Packing Groups & Specification Packaging: The Packing Group (II or III) is assigned based on the base material. Polyester resin kits must be packaged in specification combination packagings based on the performance level required for the base material, as prescribed in § 173.202, § 173.203, § 173.212, or § 173.213, as appropriate.

* Exceptions & Limited Quantities: Kits are eligible for Small Quantity (§ 173.4) and Excepted Quantity (§ 173.4a) exceptions. Limited quantity packages are excepted from labeling (unless transported by aircraft) and specification packaging requirements when packed in combination packagings, and they are not subject to placarding or shipping paper requirements (unless meeting specific hazard criteria or transported by aircraft/vessel). However, limited quantity packages must conform to general packaging requirements and cannot exceed 30 kg (66 pounds) gross weight.
