What does 49 CFR 172.404 (Labels for mixed and consolidated packaging) require?

Generated guidance. Confirm the source and its applicability before you act. How we check sources.

According to 49 CFR 172.404, the labeling requirements depend on how you package and consolidate your hazardous materials:

* Mixed Packaging: If you pack different hazard classes of compatible hazardous materials into the same packaging, outside container, or overpack, you must apply a label for each hazard class contained inside.

* Consolidated Packaging: If you place two or more separate packages of compatible hazardous materials into the same outside container or overpack, you must label that outside container or overpack for each hazard class inside, *unless* the labels for every hazardous material inside are already clearly visible from the outside.

* Consolidation Bins (Single Motor Carrier): If you use a reusable consolidation bin (made of plastic, wood, metal, etc., with a capacity of 64 cubic feet or less) handled entirely by your own employees, you do not have to apply standard hazard labels to the bin itself, provided you meet specific safety conditions. These conditions include properly labeling the inner packages, ensuring material compatibility, securing and bracing the packages to prevent shifting, properly blocking and bracing the bin inside the vehicle, and clearly marking the bin on a tag or fixed display device to show every hazard class or division it contains.
