As Ask X3, your fleet-compliance assistant, here is what 49 CFR 172.322 requires for marine pollutants:
* Non-bulk packagings for vessel transportation:
* If a proper shipping name is assigned the letter "G" in column (1) of the § 172.101 table or contains "n.o.s.", you must mark the package with the name of the component that makes it a marine pollutant in parentheses next to the proper shipping name (unless the proper shipping name already identifies that component). If two or more components contribute, include at least the two most predominant ones. (For UN3077 and UN3082, see special provision 441 in § 172.102(c)(1)).
* Place the MARINE POLLUTANT mark in association with the required hazard warning labels or, if there are no labels, next to the marked proper shipping name.
* Bulk packagings:
* For capacities under 3,785 L (1,000 gallons): Mark with the MARINE POLLUTANT mark on at least two opposing sides or two ends (excluding the bottom) so it is visible from the direction it faces.
* For capacities of 3,785 L (1,000 gallons) or more: Mark on each end and each side so it is visible from the direction it faces.
* *Note:* The mark may be in black lettering on a square-on-point configuration having the same outside dimensions as a placard.
* Transport vehicles and freight containers:
* If carrying a package subject to the marking requirements, you must mark the transport vehicle or freight container with the MARINE POLLUTANT mark on each side and each end, visible from the direction it faces (this can be satisfied by a mark already displayed on a loaded freight container or portable tank). The mark may be in black lettering on a white square-on-point configuration matching placard dimensions.
* Mark Specifications:
* The mark must feature a black fish and tree symbol on a white or suitable contrasting background in a square-on-point shape with a border width of at least 2 mm.
* For non-bulk packages, bulk packages under 3,785 L, and smaller packages, each side of the mark must be at least 100 mm (3.9 inches) (smaller marks are allowed if package size requires it, provided they remain clearly visible).
* For all other bulk packages, each side must be at least 250 mm (9.8 inches).
* Exceptions (When the mark is NOT required):
* Single or combination packagings where each single or inner package has a net quantity of 5 L (1.3 gallons) or less for liquids, or a net mass of 5 kg (11 pounds) or less for solids.
* Combination packagings containing a marine pollutant (other than a severe marine pollutant) in inner packagings of 5 L (1.3 gallons) or less net capacity for liquids, or 5 kg (11 pounds) or less net capacity for solids.
* Except for vessel transportation, on bulk packagings, freight containers, or transport vehicles that already bear a label or placard specified in subparts E or F.
* On limited quantity material packages marked in accordance with § 172.315.
