According to 49 CFR 107.339, if the Office of the Chief Counsel determines there is a substantial likelihood that transporting a specific hazardous material or container will cause death, serious illness, or severe personal injury before a standard compliance order or administrative hearing can be completed, the PHMSA Administrator (or their delegate) may take immediate legal action. Specifically, they can go to the appropriate United States District Court to request an order that suspends or restricts the transportation of that hazardous material or container, or to seek other necessary equitable relief to remove the danger.
