As a motor-carrier owner, if you receive a notice of probable violation, 49 CFR 107.317 allows you to take the following steps for an informal response:

* Submit Written Information: You may submit written explanations, information, or arguments addressing the allegations, a proposed compliance order, or the amount of the preliminarily assessed civil penalty to the official who issued the notice.

* Request a Conference: You can request a conference (either in person or by telephone) in your informal response. Your request must clearly state the issues you plan to raise.

* Scheduling: Once you request a conference, the Chief Counsel's Office (in consultation with the Associate Administrator) will arrange it as soon as practicable at a mutually convenient time and place.

After reviewing your written materials and/or your conference presentation, the Chief Counsel may dismiss the notice in whole or in part, or issue an order directing compliance, assessing a civil penalty, or both.
