What does 49 CFR 107.315 (Admission of violations) require?
Generated guidance. Confirm the source and its applicability before you act. How we check sources.
Based on 49 CFR 107.315, when responding to a notice of probable violation, a motor-carrier owner may admit to the alleged violations and agree to:
* Accept the terms of a proposed compliance order;
* Pay the amount of the preliminarily assessed civil penalty; or
* Both, if proposed in the notice.
If you agree to a proposed compliance order, the Chief Counsel will issue a final order outlining the required remedial actions.
If you choose to pay a civil penalty, follow these practical payment instructions:
* For penalties over $10,000: Payment must be made by wire transfer (Fedwire) to the U.S. Treasury account. (Contact the Federal Aviation Administration's Financial Operations Division for detailed wire instructions).
* For penalties of $10,000 or less: Payment can be made either by wire transfer, or by a certified check or money order made payable to the "U.S. Department of Transportation."
