What does 49 CFR 107.313 (Reply) require?
Generated guidance. Confirm the source and its applicability before you act. How we check sources.
According to 49 CFR 107.313, within 30 days of receiving a notice of probable violation, you must take one of three actions:
1. Admit the violation (under § 107.315);
2. Make an informal response (under § 107.317); or
3. Request a hearing (under § 107.319).
If you need more time, you can ask the Office of Chief Counsel to extend the 30-day response period, provided you show good cause and file your request within the original 30 days.
Be aware that if you fail to file a reply within this timeframe, you waive your right to appear and contest the allegations. This allows the Chief Counsel to assume the alleged facts are true and issue an order directing compliance, assess a civil penalty, or both, without any further notice. Additionally, failing to request a hearing waives your right to a hearing.
