Based on 49 CFR 107.307, when the Associate Administrator and the Office of Chief Counsel have reason to believe that a person is knowingly engaging or has knowingly engaged in a violation of federal hazardous material transportation law, applicable subchapters, exemptions, special permits, or orders, they may take the following actions:

1. Issue a warning letter.

2. Initiate proceedings to assess a civil penalty.

3. Issue an order directing compliance (regardless of whether a warning letter was issued or a civil penalty was assessed).
